GENERAL TERMS AND CONDITIONS
Please carefully read these terms and conditions before using the House of Appeal web shop (the ”Web Shop”). The Web Shop has been set up for the sale of clothing goods and accessories. By using our Web Shop and placing orders on the Web Shop, you agree to the terms and conditions and our Privacy Policy & Security. House of Appeal AB (company reg no 556821-2749) reserves the right to alter or modify these terms and conditions from time to time. Users are responsible for keeping themselves updated with eventual changes. The date of this update can be found in the final section of the terms and conditions. If at any time you do not agree to these terms and conditions, please do not use this Web Shop.

This Web Shop is operated by House of Appeal AB (“HAAB”). Throughout the site, the terms “we”, “us” and “our” refer to HAAB. HAAB offers this site including all information, tools and services available from this site, to you, the user, conditioned upon your acceptance of the terms and conditions. By ordering any of HAAB’s items, you agree to be bound by the terms and conditions.

INFORMATION IN THE WEB SHOP
HAAB has made every effort to avoid errors in the Web Shop. However, information, texts, images, graphics and other material may contain errors, be incomplete or incorrect. In such events – to the fullest extent permitted by law – we cannot be held liable for damages resulting hereof, unless such damage is the result of our gross negligence or willful misconduct. HAAB tries to reproduce the items for sale accurately in the Web Shop. However, it is not possible for us to guarantee that the colors you see in the Web Shop are exactly the same as the color of the actual item. These differences may depend on the display and color capabilities of your computer monitor and therefore we cannot guarantee that the colors are exactly the same as shown on your computer screen.

ACCESSING OUR WEB SHOP
We reserve the right to withdraw or amend the service we provide in our Web Shop, at any time and for any reason, without notice to you. We will not be liable for any reason if the Web Shop is unavailable at any time or for any period.

VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse our Web Shop by knowingly introducing viruses, Trojans, worms, logic bombs, corrupted data or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Web Shop, the server on which our Web Shop is stored or any server, computer or database connected to our Web Shop. You must not attack our Web Shop via a denial-of-service attack or a distributed denial-of-service attack. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Web Shop or to your downloading of any material posted on it or on any website linked to it.

LINKING TO OUR WEB SHOP
You may link to our Web Shop, provided you do so in a way which is fair and legal and does not damage our reputation or take advantage of it. Such linking must comply with our Intellectual Property Policy.

LINKS FROM OUR WEB SHOP
Where our Web Shop contains links to other websites and resources provided by third parties, these links are provided for your information only. The existence of a link to another website does not imply or express endorsement of its provider, product or services by us. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them or your reliance on content contained in them.

DISCLAIMERS AND LIMITATION OF LIABILITY
You agree that the Web Shop, including the content, is provided free of charge. HAAB will not be liable to you or any person for any loss or damage of any kind which may arise from the unauthorised use of the Web Shop and the use of any information contained within it.

ORDERING
The Web Shop is open 24 hours a day. However, the store can be closed due to maintenance. To place an order you are required to provide us with your personal details, contact information and payment details. Please note that it is your responsibility to provide us with valid details. By placing an order in the Web Shop, you are making an offer to us to purchase the items you have selected on these terms and conditions. We may or may not accept your offer at our discretion. The receipt you receive after you click “Buy” is an automated acknowledgement meaning we have received your submitted offer. However, the acknowledgement does not mean that we have accepted your offer, and we reserve the right to decline your offer after you have received the automatic receipt. We cannot guarantee that all items shown in the Web Shop are available in stock at the time of your order. If the item you have ordered is out of stock we will contact you as soon as possible and will give you a full refund. HAAB has the right to decline your offer if we are unable to obtain authorization for payment.
If we accept your offer, you will receive an order confirmation by e-mail from us. The contract between you and HAAB will be effective from the time that the order confirmation is sent by e-mail to you. We can only accept offers that are made through our Web Shop. We cannot accept orders by telephone, e-mails, letters or fax.

INTELLECTUAL PROPERTY RIGHTS
All items for sale in this Web Shop are for personal- and non-commercial use only. All logos, designs, graphics, photos, icons, texts, images and data provided in the Web Shop are owned or licensed by HAAB.

FORCE MAJEURE
HAAB shall be excused from the performance or punctual performance of any of its obligations under the Conditions of Sale if such performances are prevented, restricted or interfered with for any reason beyond the reasonable control of HAAB, including but not limited to, fire, flood, earthquake, explosion, strike or other casualty or accident (“Force Majeure”).

GOVERNING LAW
These terms and conditions shall be governed by and construed in according with Swedish Law. Any dispute, controversy or claim arising out of or in connection with these terms and conditions, or the breach or invalidity thereof shall be determined by Swedish courts.

PAYMENT TERMS
All prices in the Web Shop are displayed in SEK and includes Swedish VAT at 25 %. Shipping cost is added and is therefore not included in the price of the items. Shipment within Sweden is free and for international orders 100 SEK. We accept the following payment methods for our Swedish market: • MasterCard • Visa • Klarna Invoice.  Returns are made of a cost of 50 SEK. 

All credit and debit cardholders are subject to validation and authorization by both the card issuer and us to maintain security and to prevent fraud. There is no charge for payment methods MasterCard, Visa or Invoices.

DELIVERY TERMS
The Web Shop ships world wide. The Web Shop executes deliveries Monday to Friday with exceptions for Swedish public holidays. After receiving an order we will deliver your purchased items in the shortest amount of time possible. Delivery time in Sweden is estimated between 2 and 5 business days. Delivery time within the EU is estimated to 4 and 7 business days. Please note that the delivery time is to be seen as guidelines, we disclaim all responsibility due to eventual delays in transfer. When your order leaves our storage you will receive an e-mail with your tracking number so that you can follow your order. We ship ordinary mail through Posten AB. The shipping charge is 0 SEK on all orders within Sweden. For all orders the shipping charge amounts to 100 SEK for delivery within the other Nordic countries (Norway, Denmark, Finland). For other European countries (EU), the shipping fee amounts to 100 SEK. For non-European/EU countries the shipping fee varies. The package will be delivered to a delivery point that is closest to your shipping address (typically your closest post office or distribution center). You will receive a notification by mail or text message, depending on your choice, when your package is ready to be picked up. Packages that have not been collected within 14 days will be sent back to us. If you want to have your package sent again, we will charge you for the additional return shipping cost.

RETURN POLICY
If you wish to return an item you have purchased from the Web Shop you have the option to return it within 14 days after you have received the item, to a cost of 50 SEK. You will receive a full refund for the item within 30 days from the time we received the item. The return is 50 SEK within Sweden whereas the cost in other countries may vary depending on country. Please use the return label that you received with your package. If you have lost the return label; please send an email to customercare@marvillewomen.com. You are only allowed to return an item purchased from the Web Shop if it is in perfect condition. This means that the item is new, unused and has its price tag and labels fully intact. The original packaging shall also be returned. The Web Shop does not accept returns if an item is used, dirty, washed or damaged in any other way. If an item is returned and is damaged in any way the item will be returned to the customer.

EXCHANGE POLICY
HAAB cannot administrate exchanges of items that are purchased from the Web Shop. If you want to purchase a different item or another size or color please return the item purchased within 14 days from receipt and place a new order in the Web Shop.

FAULTY GARMENTS
When we ship your item, we do our best to make sure it is in perfect condition. However, in case you receive a damaged or defect item which you want to claim please contact HAAB via e-mail customercare@marvillewomen.com and we will help. Customer service will send you a return label that you can use to send back the item. You will receive a new item or a full refund for the item and all shipping costs. You will receive your refund within 30 days from the time we received the item. The claim shall be made when you discover the defect. Please note that any claim requires that you have not used the item inappropriately and that the item is not defective due to your conduct. HAAB is personal data controller and works to ensure your privacy is protected when using our services. We therefore have a policy setting out how your personal data will be processed and protected.

FAULTY GARMENTS
No guarantee is provided by HAAB on any goods sold, other than as described under “Faulty Garments”.

PERSONAL DATA
In providing your personal details you consent to us using the data collected in order to meet our commitments to you and provide the service you expect. This will include processing of orders for shipping, text message notification of delivery status, managing your account by carrying out credit checks, sending information such as new services, newsletters or other marketing offers which may be of interest and also to notify you of any changes or enhancement to our services by either email, telephone or mail from HAAB. Your details may also be used to monitor traffic to and from our website to help us improve the design and layout of the site. In the event of any problem with delivery of your items, we will use the information to get in contact with you. We never pass on/sell/swap your data to/with third parties for marketing outside HAAB. Data that is forwarded to third parties is used only to meet HAAB’s commitments to you. For example, HAAB forwards address data to suppliers and shipping agents in connection with deliveries. Your data is only stored for as long as it is needed in order to perform our services, or for the time laid down in law.

RIGHT TO FIND OUT WHAT DATA IS HELD
You have the right to contact us to find out what personal data is held about you. If it is incorrect, incomplete or irrelevant you can request that the data is corrected or deleted. You can withdraw your consent to us using your personal data for marketing purposes (e.g. sending catalogues, newsletters or offers) whenever you like.

CARD PURCHASES
To make card purchases with us as secure as possible all information is sent in encrypted form using SSL (Secure Sockets Layer). This means that the information is passed through a secure connection and that your card details cannot be read by external parties. All customers paying by card are subject to validation checks. HAAB reserves the right to delay any order if fraud is suspected. For security reasons, we do not store any payment information in our database.

COOKIES
Certain parts of the site use "cookies" to keep track of your visit and to help you navigate between sections. A cookie is a small data file that certain websites store on your computer’s hard drive when you visit them. They can contain information such as your user ID and the pages you have visited. We use cookies on the website to enable us to deliver content specific to your interests and get an idea of which parts of the site you are visiting. Our cookies do not read data from your computer’s hard drive or read cookies created by other websites you have visited. If you do not want your visit to the website to be tracked by our cookies, you can set your internet browser and/or firewall to disable them. Unfortunately, this may have a negative effect on your use of the site. Please refer to your internet browser help file to see how to disable and/or delete cookies on your PC.

LINKS TO OTHER SITES
You should be aware that when you are on our sites you could be directed to other sites where the personal information collected is outside of our control. The privacy policy of the new site will govern the information obtained from you on that site.

JURISDICTION AND APPLICABLE LAW
The Privacy Policy & Security shall be construed in accordance with Swedish law. Disputes arising in connection with the Privacy Policy & Security or use of the Website shall be subject to the exclusive jurisdiction of the Swedish courts.
